Special Election needed to fill vacancy on Prince William Board of County Supervisors

Michelle R. Robl, county attorney for Prince William Board of County Supervisors, says state law provides for a special election to fill the Neabsco District vacancy on the county board due to the death of Supervisor John Jenkins.

The board does not have the authority to appoint an acting supervisor since there are more than 180 days remaining on Supervisor Jenkins’ term, according to the county attorney.

Robl said she will ask the board at its Feb. 12 meeting to authorize her to petition the Prince William Circuit Court for a Special Election to fill the vacancy.

The writ of Special Election would, by code, be issued by Feb. 21, setting the Special Election between 45 and 60 days.

However, because the Special Election would fall within 60 days of the already set June 11 primary, the date of the Special Election could be between 30 and 60 days before or after the primary—or before April 12 or between July 11 and Aug. 10, the county attorney said.
